Lake County District Court news for Jan. 12, 2011

Judge C.B. McNeil dealt with the following cases Wednesday, Jan. 5:

Robin Bruce McNutt, 36, Butte, was sentenced to the Department of Corrections for five years to be placed in an appropriate facility for forgery, a felony, and five years for theft, a felony. Both sentences are to run concurrent. The original sentence in 2000 was deferred, and then revoked and suspended in 2002. Current sentencing is due to continual violations of probation. All conditions of probation previously imposed are re-imposed.

Timothy Felde, 52, Missoula, admitted committing amended offenses of three counts of negligent endangerment, all misdemeanors, and driving under the influence of alcohol, first offense, a misdemeanor. The court accepted the plea and found Felde guilty.

Felde was sentenced — for each of three counts of negligent endangerment — to one year with all suspended but seven days, and fined $500 for each of the three counts. For driving under the influence, Felde was sentenced to one year with all suspended but two days, and fined $2,000. All sentences are to run consecutive to each other. Felde may serve each of the seven-day sentences separately, but they mush be completed in six months, with the first served within 30 days.

According to court documents, charges stem from a Dec. 24, 2008 incident along U.S. Highway 93 on Ravalli Hill where Felde rolled his Dodge truck into a ditch, causing a wreck with other vehicles. A baby, two children and an adult female were in Felde’s truck, which did not have seat restraints. It was later determined that Felde had been driving under the influence of alcohol.

Alan Kibler, 25, St. Ignatius, was ordered to serve 60 days in Lake County Jail within six months for an amended offense of partner or family member assault, a felony, and criminal endangerment, a felony. The court deferred imposing a sentence for a total of five years.

According to court records, the charges stem from a March 2010 incident where a deputy responded to a call and talked to a woman who was very upset, had blood on her face, and numerous cockleburs were stuck in her hair and on her sweatshirt. She told the deputy that when she came home the front door was locked so she went in the back and noticed that the window was broken and the door was unlocked. Kibler was inside and they began to argue and then he slammed her through a door in the house and began to strangle her.

He prevented her from calling 911 and pushed her against the front door when she was holding her child, causing the child’s leg to be lodged between the woman and the door. She eventually climbed out of a bedroom window with her child and ran into the woods. Kibler was then found hiding in the bedroom of the home and was placed under arrest.

Luke Patrick, 36, Polson, was sentenced to Montana State Prison for ten years with five suspended for robbery, a felony, and five years for criminal possession of dangerous drugs. The terms are to be served consecutively for a total of 15 years with five suspended.

According to court documents, charges stem from a Sept. 3 incident when Patrick, who was on probation after serving time for robbery, allegedly would not allow his probation officer to enter his residence. Patrick locked the doors and hid in the attic, but was arrested after law enforcement officers pepper-sprayed the attic area. Patrick tested positive for the presence of methamphetamine and his SCRAM bracelet indicated he had also been consuming alcohol the same day.

 

Judge Deborah Kim Christopher dealt with the following cases Thursday, Jan. 6:

George M. Moore, 56, Ronan, was sentenced to the Department of Corrections for 13 months plus and additional five years with all suspended for driving under the influence of alcohol or drugs, a felony.

According to court documents, charges stem from a May 2010 incident where Moore was pulled over for speeding in Pablo. The officer noted a strong odor of alcohol, but Moore said it was from pain medication he was taking for surgery he had on his hand. Moore’s driving record indicated he had three prior convictions for driving under the influence of alcohol. Moore failed a field sobriety test and was transported to the Lake County Detention Center where he was further processed for driving under the influence of alcohol.

Jacob Beeks, 29, admitted to committing an amended offense of criminal endangerment, a felony, and driving while suspended or revoked, a misdemeanor. The court accepted the plea agreement and found Beeks guilty. Sentencing is set for Thursday, Feb. 10 at 9 a.m.

According to court documents, charges stem from an Oct. 31 incident where a tribal officer pulled Beeks over for speeding on Skyline Drive and nearly losing control of the vehicle. The officer noted a strong odor of an alcoholic beverage, and Beeks was asked to perform three field sobriety tests, results of which indicated that he was under the influence of alcohol.

Andrew Ostrander, 20, Ronan, admitted to an amended offense of theft, a felony; criminal endangerment, a felony; and driving under the influence of alcohol, a misdemeanor. The court accepted the plea agreement and found Ostrander guilty. Sentencing is set for Thursday, Feb. 10 at 9 a.m.

According to court records, the theft charges stem from an October 2010 incident where Ostrander was pulled over around 5 a.m. on Valley Creek Road, just off Highway 93, because the brake lights on the vehicle he was driving were turning on and off. Ostrander had two other males in the car with him. The vehicle was stolen, along with golf clubs, a GPS, and other items Ostrander said had been stolen from cars. Guns and drug paraphernalia were also found in the car. 

According to court records, criminal endangerment and driving under the influence of alcohol charges stem from a Feb. 7, 2010, incident where Ostrander caused a wreck on Highway 93 near mile marker 43, causing injury to a minor riding in his vehicle and injury to the other driver. A blood draw shortly after the crash determined Ostrander had a blood alcohol concentration of .16 percent.

Robin Bruce McNutt, 36, Butte, was sentenced to the Department of Corrections for two years for criminal possession of dangerous drugs, a felony. Previous conditions of probation were also imposed.

According to court records, charges date back to July 2001, when McNutt was found in possession of methamphetamine while in Lake County.
