Judge C.B. McNeil dealt with the following cases Wednesday, June 8:
Twila Dawn Azure, 47, Ronan, was sentenced to the Department of Corrections for five years following an. Aug. 10, 2010 petition to revoke an order suspending sentencing for driving under the influence of alcohol or drugs, fifth or subsequent offense. Azure is to be considered for placement at the Elkhorn Treatment Center followed by pre-release provided it meets with the approval of the DOC.
According to court records, suspended sentencing was revoked due to probation violations allegedly involving the possession of dangerous drugs, drug paraphernalia and obstruction of a peace officer that occurred during response to a fight at the Wolf Den Bar Aug. 4, 2010.
Roger William Bordeaux, 59, Polson, pled not guilty to driving under the influence of alcohol, fourth or subsequent offense. An omnibus hearing has been set for Wednesday, Aug. 10. A jury trial has been scheduled for Monday, Oct. 3.
According to court records, charges stem from a May 31 incident during which Bordeaux allegedly drove into a person’s driveway while drinking, offered him a beer and then tried to sell him a pie. The man telephoned his neighbor, a Montana Highway Patrol officer, to advise him that Bordeaux was headed to his residence. The officer phoned his wife who reported that the suspect’s vehicle was stopped on Ninepipe Road and that the driver appeared to be urinating on the side of the road. She reported that the driver drove away heading towards Charlo. Tribal officer T.J. Haynes located the suspect’s vehicle in the parking lot of Tiny’s Bar in Charlo. Two open Budweiser beer cans, one empty in the backseat, were observed inside the vehicle. The bartender told officers that Bordeaux had just gotten there and not yet entered the bar. Officers noticed an odor of alcoholic beverage on Bordeaux’s breath. A breath sample registered .178 blood alcohol content. Knowing the defendant’s history of prior convictions, Montana Highway Patrol officer Anderson took over the investigation as the offense was a felony.
Robert Deneault, 42, Ronan, pled guilty to the amended offenses of sexual assault, a felony, and partner or family member assault, a misdemeanor. A pre-sentence investigation and report, including a psychosexual evaluation of Deneault, were ordered. Sentencing has been set for July 13.
According to court documents, charges stem from alleged incidences that date back to July 2001 through October 2003, when the reporting female said that her father, Deneault, began acting sexually inappropriately when she was 9 years old. When his advances turned into actions at age 14, she reported the behavior to authorities (September 2003), yet the case was not prosecuted. The victim was concerned that if she continued with criminal proceedings, she might be excluded from the family. But when her 13-year-old stepsister recently confided that Deneault had begun to be sexually inappropriate with her, the older sister became concerned for the safety of her sisters and again reported the abuse to a Lake County Sheriff’s detective.
The victim also recounted recent incidences where Deneault had made inappropriate comments to other individuals, and displayed inappropriate behavior while traveling alone with the now 21-year-old daughter.
The detective obtained a search warrant to digitally record conversations between the older daughter and Deneault. According to court records, the recording revealed that Deneault made admissions to inappropriate behavior and apologized for the “sexualness” that happened between himself and his daughter.
Judge Deborah Kim Christopher dealt with the following case Thursday, June 9:
Gerald Wayne Sharp Jr., 44, Pablo, pled not guilty to the offense of driving under the influence of alcohol or drugs. An omnibus hearing has been set for July 14. A jury trial is scheduled for Aug. 22.
According to court documents, charges stem from a March 13 traffic stop during which Sharp allegedly appeared intoxicated to a tribal officer. Lake County Sheriff deputy Clay Shoemaker responded to the scene and after observing the defendant was unsteady on his feet and detecting the odor of an alcoholic beverage, proceeded to administer a field sobriety test. A preliminary breath test indicated a blood alcohol concentration of .354.
