Lake County District Court news for Aug. 24, 2011

Judge C.B. McNeil dealt with the following cases Aug. 17:

Nicole Madplume aka Nicole Amaya, 23, Polson, had her sentence deferred for three years. 

According to court documents, Madplume was charged with an amended offense of criminal possession with intent to distribute from an October 2009 incident where she attempted to ship marijuana and two types of schedule II drugs to her mother-in-law, sealed and concealed in a bag of coffee grounds.

Brian Johnston, 37, Polson, pleaded not guilty to three counts of incest, all felonies. An omnibus hearing is set for Wednesday, Sept. 21 at 9 a.m., and jury trial is set for Monday, Nov. 28 at 9 a.m.

According to court documents, charges stem from three incidents between April 2010 and June 2011 when Johnston allegedly had sexual intercourse and other sexual interaction with two minor descendents.

The maximum sentence for felony incest is 100 years each or a life term each.

Johnston is a registered sex offender with the Lake County Sheriff’s Office, and had been released from prison April 20, 2010. He is currently on probation for possession of dangerous drugs.

Randall Michell, Jr., 24, St. Ignatius, pleaded not guilty to burglary, a felony; and theft, a felony. Mitchell remains at liberty. An omnibus hearing is set for Wednesday, Oct. 5 at 9 a.m. and a jury trial on Monday, Dec. 19 at 9 a.m.

According to court documents, charges stem from a May 31 incident where Michell allegedly entered a home in Arlee and stole three rifles, alcoholic beverages, backpacks and other items.

Daniel Street, 23, Hardin, had his suspended sentence for felony sexual intercourse without consent revoked, and was sentenced to Montana State Prison for 11 years with seven suspended. He is also required to complete two phases of sexual offender treatment program before he will be eligible for parole.

According to court documents, Street admitted violating parole by consuming intoxicants.

 

Judge Deborah Kim Christopher dealt with the following cases Thursday, Aug. 18:

Gale Lee Eneas, 50, Elmo, pleaded not guilty to criminal possession of dangerous drugs, a felony. Eneas remains at liberty. An omnibus hearing is set for Thursday, Oct. 20 and jury trial for Dec. 12, both commencing at 9 a.m.

According to court documents, charges stem from a March 10 incident where two tribal police officers obtained a search warrant and searched Eneas’ residence. Inside they found paraphernalia used to ingest marijuana and a small tin containing hash.

Gregory Staat, 21, St. Ignatius, in a change of plea admitted committing theft, a felony. The court accepted Staat’s plea and the plea agreement and found him guilty. A restitution hearing on the day of sentencing will determine if the items stolen are valued at less than $1,500; if they are, Staat may withdraw his guilty plea and the state will change the charge to a misdemeanor.

Sentencing is set for Thursday, Sept. 29 at 9 a.m.

According to court documents, charges stem from an incident that occurred sometime between April 25 and May 2, where Staat and an accomplice allegedly entered a wrecking yard on Songer Road and stole several items — including four vehicle rear ends, twenty starters and alternators, and four radiators — and then took them to Axmen in Missoula and sold them for scrap metal.

Justin Duane Onesalt, 23, Pablo, had his suspended sentence for negligent homicide revoked, and was sentenced to the Department of Corrections for 15 years with 10 years suspended. Previous conditions are reimposed.

According to court documents, Onesalt admitted he violated parole by moving from Hardin to Lake County; by not reporting bimonthly to his probation and parole officer; and by testing positive for methamphetamine and marijuana.

Kurt McComb, 51, Alberton, had his deferred sentence for burglary and criminal possession of dangerous drugs, both felonies, revoked. He was sentenced to the Department of Corrections for 10 years with five suspended. He was also recommended for Connections Corrections followed by a requirement that he attend the Mineral County Drug Treatment Center. Previous conditions of parole and probation are reimposed.

According to court documents, McComb admitted violating parole by appearing in court August 4 while he was intoxicated.
