Judge C.B. McNeil dealt with the following cases Wednesday, Oct. 5:
John Hendrickx, 42, Ronan, was sentenced to 13 months in the Department of Corrections, following which he is sentenced to five years in the DOC or Montana State Prison, all suspended. The sentences are to run consecutively.
According to court documents, charges stem from a Jan. 1 incident where Hendrickx was arrested in Ronan for driving under the influence of alcohol. His driving recorded showed three prior DUI convictions.
Buffy Antonietti, 43, Polson, pleaded not guilty to issuing a bad check, common scheme, a felony. An omnibus hearing was set for Wednesday, Dec. 7, and a jury trial is set for Monday, Feb. 6. Both begin at 9 a.m. Antonietti remains at liberty.
According to court documents, charges stem from approximately 20 incidents between December 2009 and February 2011 when Antonietti allegedly wrote checks on closed accounts at Eagle Bank and Community Bank to various merchants in Lake County. Antonietty entered into a restitution payment agreement in April 2010 but failed to pay restitution as agreed.
Randy Lee McBroom, 36, Ronan, had his suspended sentences for two separate counts of criminal possession of dangerous drugs, a felony, revoked and was sentenced to three years in the Department of Corrections plus five years, three suspended. The sentences are to run consecutively. McBroom will receive credit for time served while in custody, and the court recommended he be considered for Connections Corrections, pending approval of the DOC.
According to court documents, McBroom admitted violating several conditions of his probation and parole from 2009-11 by failing to report to his probation officer; testing positive for THC, the active compound in marijuana; consuming alcohol; purchasing alcohol; entering bars; and failing to maintain full-time employment. Original charges stem from two 2005 incidents: one where methamphetamine was found on McBroom’s person and one where methamphetamine was found in his house.
Judge Deborah Kim Christopher dealt with the following cases Thursday, Oct. 6:
Scott Wade McAfee, 32, Ronan, was sentenced on three counts of felony burglary and three of felony theft. McAfee was sentenced to five years in the Department of Corrections for theft, a felony; 10 years with five suspended for burglary, a felony; 10 years with five suspended for theft, a felony; one year for burglary, a felony; 10 years with five suspended for theft, a felony; and one year for burglary, a felony.
According to court documents, charges stem from a 2001 incident when McAfee stole a large amount of coins from a Ronan residence. McAfee admitted violating several conditions of his probation and parole during 2010 and 2011 and had his suspended and deferred sentences revoked.
Michael Charlo, 49, Charlo, was sentenced to the Department of Corrections for 15 years with 10 suspended for driving under the influence of alcohol or drugs, a felony. Charlo was also ordered to pay jury costs of $1,009.56 and after his release, to wear an alcohol-monitoring bracelet for one year. Charlo also had his suspended sentence for driving under the influence of alcohol, a felony, revoked and was sentenced to the Department of Corrections for five years, all suspended.
According to court documents, charges stem from a September 2010 incident where a Lake County Sheriff’s deputy responded to a report of a truck that was disabled and blocking traffic on Sloan’s Bridge Road in Lake County. The deputy found Charlo lying down in the cab of the truck, and when Charlo sat up, the deputy smelled alcohol on him. The deputy asked Charlo to step out of the vehicle, and Charlo did so and removed his keys from the ignition. A breathalyzer test showed Charlo had a blood alcohol content above .100. After Charlo was arrested and taken to the Lake County Jail, a second breath sample showed he had a blood alcohol content of .144.
The September 2010 incident was a violation of Charlo’s probation for a 2008 felony conviction of driving under the influence of alcohol or drugs.
Gerald Wayne Sharp, Jr., 44, Pablo, was sentenced to 13 months in the Department of Corrections and an additional five years, all suspended, for driving under the influence of alcohol or drugs, a felony. Sharp also had his suspended sentence for driving under the influence of alcohol, a felony, revoked and was sentenced to four years and 335 days, all suspended, in the Department of Corrections. The sentences in the two cases will run consecutively.
According to court documents, recent charges stem from a March 13 incident where a Flathead tribal police officer pulled Sharp over while Sharp was driving intoxicated. Records showed Sharp had five previous DUI convictions and had never been placed in a treatment program.
Debra Bird, 58, St. Ignatius, received a three-year deferred sentence and was committed to the Lake County jail for 45 days for the amended offense of criminal endangerment, a felony. If Bird successfully completes an inpatient chemical dependency treatment program, the 45 days of jail time will be satisfied.
According to court documents, charges stem from a May 19 incident where a deputy followed up on a report of Bird leaving a restaurant in Polson and driving erratically southbound on U.S. Highway 93. He saw her car south of Ronan and observed her cross the fog line about five times between Highway 212 and Dublin Gulch Road. He stopped the vehicle and noticed the odor of an alcoholic beverage on her breath, but Bird refused field sobriety tests and refused to give a breath test. She admitted having several glasses of wine and was on several pain medications.
Her driving record indicated four prior DUI convictions, and she was arrested.
Vernon Tenas, 43, Elmo, in a change of plea, admitting committing the amended offense of criminal production or manufacture of dangerous drugs, a felony. Tenas was found guilty, and sentencing was set for Thursday, Nov. 17, at 9 a.m.
According to court documents, charges stem from a February 23 incident where U.S. Marshals, assisted by Flathead Tribal Police, attempted to serve an arrest warrant in a home. Inside they found marijuana plants, grow lights and paraphernalia used for smoking marijuana.
