Lake County District Court news for Feb. 15, 2012

Judge C.B. McNeil dealt with the following cases Wednesday, Feb. 8:

Valdena Curley, 35, Pablo, was sentenced to the Department of Corrections for five years, all suspended but 60 days in the Lake County Jail, to be served within six months, for criminal possession of dangerous drugs, a felony. Curley will receive full credit for time served while in custody. If Curley enters and successfully completes a chemical dependency program within six months, jail time will be waived. 

According to court documents, charges stem from a January 2011 incident where Curley had to be taken to the hospital from the tribal complex in Pablo after taking pills. She had in her possession Gabapentin, Xanax and Ambien. Xanax and Ambien are controlled substances and Curley did not have a prescription for them.

Carl Anthony Draper Jr., 34, Polson, in a change of plea, admitted to the amended offense of assault, a misdemeanor. He was found guilty and sentenced to six months in the Lake County Jail, all suspended but 128 days. Draper received credit for 128 days served and was released.

According to court documents, charges stem from an October 2011 incident where a woman told Draper that she wanted him to move out of her house. Draper then got a .45 semiautomatic pistol and pressed the barrel of the gun to her forehead. Draper told her he was going to kill her and her cat. She requested they go outside for a cigarette, and then she slipped back into her house and called the police. The police found Draper outside and the victim inside. The gun was also located inside the home. The victim was visibly shaken and crying, and said, “Don’t let him go, he will kill me.”

Mary Tewawina, 22, St. Carlos, Ariz., had her 2008 deferred sentence for theft, a felony, revoked. Sentencing was deferred for 2 1/2 years except for 45 days in the Lake County Jail, after which Tewawina will be released. She will receive credit for time served while in custody and while in custody in Arizona.

According to court documents, Tewawina violated her probation by failing to comply with supervision of her Arizona probation officer.

 

Judge Deborah Kim Christopher dealt with the following case Thursday, Feb. 9:

William Pounds, 66, Polson, was sentenced to the Department of Corrections for five years, all suspended. 

According to court documents, charges stem from a July 19 incident where Pounds allegedly fired a .40 caliber handgun in a home during a family reunion. He then reloaded and allegedly fired at a woman and her father as they hid in a vehicle outside. When Sheriff deputies, Montana Highway Patrol and Tribal Police arrived, Pounds was in the residence alone. The officers staged in two teams and Pounds was eventually tackled. A deputy noticed 11 gunshot holes in the ceiling and several spent casings.
