POLSON — The Federal Energy Regulatory Commission issued an “Order Denying Rehearing,” sending a resounding message to those who formally opposed the transfer of Selis Ksanka Qlispe FERC Project No. 5, which is the former Kerr Dam project.
On Nov. 19, the FERC delivered the order denying the motion for a rehearing of the partial transfer of SKQ Dam to the Confederated Salish and Kootenai Tribes and Energy Keepers, Inc. The petitioners interested in a recall of the partial transfer were the Montana Land and Water Alliance, Senators Verdell Jackson and Bob Keenan, and the Montana Public Service Commission. Each party respectively filed on Sept. 30 and Oct. 1.
“The order finds that the issues raised on rehearing largely relate to a self-executing conveyance established in the final 1985 license for the project, and are not germane to the partial transfer order, and the order affirms that the partial transfer to Energy Keepers Incorporated, is in the public interest,” according to EKI legal counsel.
“The Order is simple, but comprehensive and emphatic,” said Joe Hovenkotter, EKI General Counsel. “It adopts the arguments presented by CSKT and Energy Keepers. It absolutely rejects all arguments by the Petitioners.”
This is the final agency action by the FERC with regard to CSKT’s and EKI’s application for co-licensee status, closing a chapter in the ongoing story of the historic acquisition by the CSKT and EKI.
