HELENA – A Lake County man will continue serving a 25-year sentence, with 10 of those years suspended, for felony driving under the influence after the Montana Supreme Court refused to grant an appeal on April 7.
Wayne TwoTeeth, 48, was sentenced to the Montana State Prison on Jan. 9, 2014 for felony DUI. He appealed the high court, saying his sentence was over the legal five-year limit for DUI.
The high court disagreed, saying TwoTeeth was a persistent felony offender who had a record of multiple DUIs.
“TwoTeeth met the criteria for the Lake County District Court to sentence him under this statute,” Chief Justice Mike McGrath wrote. “TwoTeeth was designated a PFO in 2005. He was under the supervision of DOC, Adult Probation and Parole Division, pursuant to the conditions in his 2005 sentence. From a review of electronic records, we have ascertained that TwoTeeth was discharged successfully from the Montana Chemical Dependency Center on January 16, 2013 and was placed at a Sober Living Home. He removed himself from the home without authorization from his Probation and Parole Officer in April 2013.”
The district court could have sentenced TwoTeeth to as many as 100 years in prison, the high court concluded.
