Judge Deborah Kim Christopher dealt with the following cases Thursday, Feb. 17:

Theresa McNair, 24, Ronan, pleaded not guilty to assault on a peace officer or judicial officer, a felony. An omnibus hearing is set for Thursday, April 21 at 9 a.m. and a jury trial for Monday, June 13 at 9 a.m.

According to court documents, charges stem from a Feb. 2 incident where detention officers were trying to move McNair into a solitary cell at the Lake County Detention Center while noticeably intoxicated. When McNair was placed in the cell, she refused to remove her street clothes and put on the detention-issued pants and shirt. After three failed attempts to get McNair to comply with verbal instructions, two officers physically assisted McNair on the bed in the cell, one attempting to restrain her arms and the other her legs. McNair then allegedly kicked the female officer who was attempting to restrain McNair’s legs, hitting her in the rib cage, on the right side of her face, and the left side of her forehead, causing visible marks and swelling.

Xavier Streets, 17, St. Ignatius, pleaded not guilty to sexual intercourse without consent, a felony. An omnibus hearing is set for Thursday, April 7 at 9 a.m. and a jury trial for Monday, May 23 at 9 a.m. Although a minor, Streets is being tried as an adult.

According to court documents, charges stem from an August 2010 incident where detectives followed up on a report from a social services investigator, and interviewed two young girls who had been babysat by Streets. Although one girl did not disclose inappropriate contact with Streets, the other, a five-year-old, said Streets had made her do things consistent with oral sex. In an interview where Streets parents were present, Streets denied the allegations but later admitted to his mother that the child was telling the truth. According to the official court affidavit, one day later Streets admitted in an interview with a detective that the allegations were correct, and the alleged incident happened on only one occasion, about a year prior. Streets also said he had given the child a sucker and told her not to tell anyone what had happened.

Nathan Russell, 20, Pablo, was sentenced to 20 days in the Lake County Jail for criminal possession of dangerous drugs, a felony. Russell will be credited for one day already served, and must complete the remaining jail time within 90 days of sentencing.

According to court records, charges stem from an August 17 incident where a Montana Highway Patrol officer observed what appeared to be a drug transaction at Pier 93 gas station in Polson. After asking permission to search the vehicle, the trooper found several individually packaged bags of marijuana labeled by variety and price, plus several hydrocodone tablets. Russell admitted the marijuana was his, that it was intended for sale, and the tablets were also his and he did not have a prescription for them.

Chris Grenier, 21, Ronan, changed his plea and admitted to an amended offense of sexual assault with bodily injury, a felony. The court accepted the plea and found Grenier guilty. A PSI was ordered but a date was not set for sentencing.

According to court documents, charges stem from a May 2010 incident where officers responded to a hospital where a woman had reported that Grenier raped her while attending a party in the early morning hours at Kerr Dam. Officers later found articles left at the site that were consistent with the woman’s account.
